Terms of Service

1. Acceptance

By creating a Deskmira account or using any part of our service, you agree to these Terms. If you do not agree, do not use the service.

2. Description of service

Deskmira is a SaaS platform that helps medical spas automate Instagram DM replies, qualify leads, and collect booking deposits. The service includes AI-generated message drafts, Google Calendar integration, and Stripe deposit collection via the spa’s own Stripe account.

3. Eligibility

You must be at least 18 years old and operating a legitimate business to use Deskmira. By using the service you represent that all information you provide is accurate.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@deskmira.com if you suspect unauthorized access.

5. Acceptable use

You agree not to:

• Use Deskmira to send spam or unsolicited messages.
• Use Deskmira to provide medical diagnoses, treatment plans, or regulated medical advice.
• Collect or process protected health information (PHI) through Deskmira — the service is not HIPAA-covered in Phase 1.
• Violate Meta’s Messaging Policy or any applicable platform terms.
• Reverse-engineer, decompile, or attempt to extract the source code of Deskmira.
• Resell or sublicense access to Deskmira without written permission.

6. AI-generated content

Deskmira generates draft replies using AI. You are solely responsible for reviewing, approving, and sending messages to your clients. We are not liable for the content of AI-generated drafts that you choose to send. You should not rely on Deskmira to provide medical advice, and you must ensure all client communications comply with applicable laws.

7. Payments and billing

Deskmira charges a flat monthly subscription fee. The first 50 medical spas pay $49/month (normally $99/month). All plans include a 30-day free trial — no credit card required to start. Subscription billing is handled by Lemon Squeezy. Client deposits are collected directly through your own Stripe account; Deskmira takes no percentage of deposits. Subscription fees are non-refundable except where required by law.

8. Third-party integrations

Deskmira integrates with Meta (Instagram), Google (Calendar), and Stripe. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or actions of these third-party services.

9. Intellectual property

Deskmira and its original content, features, and functionality are owned by us and protected by applicable intellectual property laws. You retain ownership of all content you provide (treatment menus, FAQs, voice samples, messages). You grant us a limited license to use that content solely to operate the service.

10. Disclaimers

Deskmira is provided “as is” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate. You use the service at your own risk.

11. Limitation of liability

To the fullest extent permitted by law, Deskmira shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

You may cancel your account at any time from the billing page. We may suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, your right to use the service ceases immediately. We will delete your data within 30 days per our Privacy Policy.

13. Changes to terms

We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Deskmira operates, without regard to conflict of law principles.
